   Given growing concern and demand for the protection of personal information in all sectors of society,
Kyosan has developed a personal information privacy policy to address the protection of the personal information (hereafter 'personal information') of customers and business affiliates obtained in the course of carrying out our business. With respect to the handling of personal information, Kyosan endeavors to respect and obey all applicable laws, ordinances, rules, regulations and government guidelines and mandates and other applicable rules, regulations and standards (hereafter collectively "all applicable laws and regulations") and pledges to abide by all international trends and agreements for the protection of personal information as well as to develop, maintain and enforce its own expressly developed policy for the protection of personal information, as outlined below.
Privacy Policy
1. This Personal Information Privacy Policy has been established by the Kyosan Electric Mfg. Co., Ltd., and pertains to and is to be promulgated to all company executives (same hereafter), employees (including employees on probation, temporarily-assigned employees, subcontractors, and part-time employees - same hereafter), and all outsourced personnel (collectively referred to hereafter as "employees"), and is to be carried out it in the processing of all personal information, and periodically maintained, and updated.
2. Kyosan shall implement the appropriate security measures to guard against unauthorized access, computer viruses, and to prevent the loss, destruction, corruption or leakage of confidential personal information.
3. The company shall obtain personal information as appropriate, by honest and appropriate means, and not by unauthorized means, nor without the approval of the individual to whom the information belongs (hereafter"the individual"). Furthermore, the company shall obtain the approval of the individual when obtaining the information and clearly indicate the nature and purpose of information the company obtains on its website.
4. When obtaining personal information indirectly, all efforts shall be made to ascertain the accuracy of the information and that information being submitted by a provider has been appropriately obtained from the individual.
5. The company shall, immediately, and without objection, respond to requests from any individual to disclose, amend, or delete information, recognizing the individual's rights to have these actions performed.
6. In instances where the company jointly uses or shares personal information with another company, or assigns the processing thereof to another organization, the company shall take all necessary legal and other measures to assure the privacy and protection of the information.
7. The following principles shall govern the collection and processing of personal information:
Use of Personal Information
The use and processing of personal information shall be carried out within the scope of the purpose or purposes for which it was collected, only by individuals expressly authorized to do so, within the limits of said authorization. Kyosan collects information for purposes as follows:
[1]  Information required for the development, design, manufacture or sale of the company's products, product servicing or repair, or for quality enhancement purposes.
[2]  In order for the company to contact an individual.
Policy Provisions
As a principle, personal information shall not be divulged to a third party.
Personal information shall not be used for other than the original purposes for which it was collected, removed from its customary location, leaked outside the company or shared or transmitted by any means.
Employees shall not indiscriminately share personal information obtained during the course of business activities with a third party or use personal information for inappropriate purposes. The same applies to when an employee leaves the company; the employee must take appropriate measures to assure the security of personal information that was under his or her care.
Sensitive (confidential) information such as that noted below, shall not be collected, used, or provided unless necessary and then only with the individual's clear consent.
(1) Race, ethnicity, origin or registered domicile (excluding information publicly available at government offices where the individual lives), or factors which might subject the individual to discrimination or social disadvantage such as physical or psychological challenges or criminal record.
(2) Information relating to an individual's exercise of the right to participate in labor organizations or collective bargaining, and or the individual's activities in other organizations.
(3) Information relating to an individual's exercise of the right to participate in peaceful assembly or petition the government.
(4) Information pertaining to an individual's insurance or medical claims history.
(5) Any and all information pertaining to the internal aspects of an individual's private life such as thoughts, belief, creed, religion or sexual preferences.
